Franklin Henderson, a Bretz & Coven, LLP, client, was granted a 212(c) waiver of deportation by an Immigration Judge in 1996, at a time when interpreting new laws under AEDPA was not clear. The former INS arrested and detained him as he walked out of the courtroom. However, Mr. Bretz fought for Mr. Henderson and challenged the mandatory detention laws and retroactive application of the AEDPA in federal court and won. Not only did Mr. Bretz save Mr. Henderson from deportation, but with Bretz & Coven, LLP, by his side, on September 22, 2005, Mr. Henderson became a United States citizen! Thus, even in the face of rough tactics by the Government, there is always hope of prevailing. Mr. Henderson is living proof of that.
