Understanding Visas

Attorneys Help You Understand Visas in New York City

We can be your guide for the complex immigration process

If you want to work in or visit New York or anywhere else in the United States, you need the appropriate U.S. government visa. Howevernot all visas are alike. Simply obtaining a tourist or business visitor visa may not be enough if you plan to work or stay in the country for an extended period. Some types of visas may even require you to have a sponsor within the United States or ties to a U.S. citizen. Understanding visas is a key to a successful and prosperous trip. At Bretz & Coven, LLP, we have built a nationwide reputation advising individuals and businesses on the steps they need to take to make this happen.

Prerequisites for obtaining a visa

While some types of visas are fairly straightforward, others may require substantial documentation. The treaties under which the E-1 and E-2 visa programs operate were designed to expedite travel for citizens of treaty countries. However other economic visas, such as E-B5 visas may require documentation that your investment or enterprise meets the required qualifications. Others, such as F and M student visas and L-1A and L-1B intracompany transfers may require coordination with a school or company within the United States.

Rarer types of visas, such as O and P visas for international celebrities and athletes or U visas for crime victims, may entail an investigation into the identity and qualifications of the applicant. Participation in the special immigrant juvenile program may even require coordination with state courts within the United States.

Visa compliance

Of course, obtaining your visa is only the first part of the process. Nearly every type of visa carries some limitations and ongoing compliance requirements. Failure to follow these requirements can lead to revocation and transition to non-citizen status, including the possibility of deportation. K visas, for instance, require that the issuant be married within 90 days of entering the country. Other types of visas may also be revoked for various reasons:

  • Dis-enrollment from school
  • Termination of sponsored employment
  • Noncompliance with immigration laws
  • Commission of a crime

For these reasons, it is important to consult an experienced New York immigration attorney who can help you obtain a visa and advise you of your ongoing obligations once you have been admitted to the United States.

Immigration Consequences of Criminal and Fraudulent Conduct
The immigration consequences of criminal or fraudulent conduct can be harsh and often illogical. Even a very minor offense could have a dramatic immigration consequence, including deportation, detention without bond, being denied naturalization, a visa or re-entry into the United States. Likewise, the use of fake or fraudulent documents, aliases, and other misrepresentations can have similar immigration consequences. Kerry Bretz and Bretz & Coven have been counseling non-citizen criminal defendants, as well as their lawyers, for over 20 years. We have a long history of strategizing deportation and removal defenses, as well as applications for waivers, in very complicated cases.
